Resumo: The issue of constitutional justice and the constitutional process is a subject that has recently become a constant target of debate in the current legal scene. Whether due to political or administrative issues related to constitutional law, the fact is that the field of discussions regarding the discretionary power and the limitation of the Judiciary's actions has received relevant attention, highlighting the interference of the Federal Supreme Court in the control of the powers' functions (check and balances) and the limits to this action. Thus, in literature and legislation review, observing the exploratory descriptive method, the research aims to analyze the constitutional procedural law and constitutional justice, in the protection of the Constitution, the current scenario of procedural activism by the Supreme Court, the parameterization of constitutional justice.

Seja por questões políticas ou administrativos ligado ao direito constitucional, fato é que o campo de discussões quanto à discricionariedade e a limitação da atuação do Poder Judiciário tem recebido atenções relevantes, destacando-se as interferências do Supremo Tribunal Federal no controle das funções dos Poderes (check and balances) e os limites a essa atuação.
