Resumo: This article investigates the democratic understanding of the duty to justify decisions, deconstructing the mistaken idea that reasoning would be synonymous with motivation. From the Constitutionalist Theory of Process and the counterpoint between the two concepts, it is shown that the jurisdictional activity is still impregnated with high loads of subjectivity, which prevents the democratization of the jurisdictional activity. For the present study, bibliographic research and the deductive method will be used, starting from a macro perspective for a micro analytical conception about the subject under study and, finally, as a technical procedure, the thematic, theoretical and interpretive.

A partir da Teoria Constitucionalista do Processo e do contraponto entre os dois conceitos, demonstra-se que a atividade jurisdicional ainda se encontra impregnada de altas cargas de subjetividade, o que obsta a sua democratização.
