Resumo: This study aims to analyze the principle of dialecticality of appeal, under the focus of the dialectical structure of the process and the participatory model established by the CPC/15, in order to assess the risks of its application by the Higher Courts, against the practice of defensive jurisprudence by the Courts, that is, the illegitimate restriction on the right to appeal, consolidated in a disproportionate attachment to its formal requirements, based on distorted interpretations and applications of legal-normative enunciations, with the purpose of reducing the workload imposed on the Judiciary, especially in relation to the interpretation given to article 489, first paragraph, item IV of CPC/15.
