Resumo:   ABSTRACT: The pandemic period requires the readjustment of the Judiciary and the need to adopt measures that would allow the continuity of the provision of jurisdictional activity, without putting the health and life of everyone in its structure, lawyers, parties and the general public at risk. Through the incorporation of technologies, it was possible that the provision of jurisdictional activity would not be totally paralyzed, allowing, among others, the holding of hearings through videoconference. In view of this, the present study aims to bring reflections on the (in) existence of breach of procedural guarantees with the employment of labor instruction hearings by videoconference, due to the questions posed by the legal community. To this end, a bibliographic search and examination of the legal literature was carried out, using the inductive method.

To this end, a bibliographic search and examination of the legal literature was carried out, using the inductive method.O período pandêmico demandou a readaptação do Poder Judiciário e a necessidade de adoção de medidas que possibilitassem a continuidade da prestação da atividade jurisdicional, sem que se colocasse em risco a saúde e a vida de todos que integram sua estrutura, advogados, partes e público em geral. Através da incorporação de tecnologias foi possível que a prestação da atividade jurisdicional não ficasse totalmente paralisada, permitindo-se, dentre outros, a realização de audiências por meio de videoconferência. Diante disso, o presente estudo objetiva trazer reflexões sobre a (in)existência de quebra de garantias processuais com o emprego das audiências de instrução trabalhistas por videoconferência, em razão dos questionamentos postos pela comunidade jurídica.
