A PROTEÇÃO JURÍDICA À VÍTIMA DE NEOPLASIA MALIGNA À LUZ DO ORDENAMENTO JURÍDICO BRASILEIRO

RESUMOO tema da pesquisa é a proteção jurídica às vítimas de neoplasia maligna, cuja relevância fica evidenciada diante do elevado número de ocorrências dessa moléstia. Objetiva-se apontar os principais diplomas legais pátrios que amparam pacientes acometidos por tal doença e verificar se têm efetividade tanto no que diz respeito à publicização dos benefícios quanto ao atendimento das necessidades atinentes à saúde. Trata-se de uma pesquisa exploratória, amparada no método indutivo, abrangendo revisão bibliográfica sobre o histórico da doença, seu surgimento, as consequências e os tratamentos disponíveis, para, então, apontar a atuação do Estado no cumprimento de seus deveres e na promoção da saúde pública, em especial, no que tange aos preceitos da Lei nº 12.732/2012 e aos benefícios elencados na legislação. A pesquisa contempla entrevistas com pessoas que passaram por tratamento oncológico custeado pelo Estado, etapa essa em consonância com a Resolução nº 510, de 2016, uma vez que o projeto foi inserido na Plataforma Brasil e devidamente aprovado pelo Comitê de Ética e Pesquisa da Universidade Feevale. Como resultado, pode-se afirmar que um dos principais diplomas de proteção às vítimas de neoplasia maligna é a Lei nº 12.732/2012, trazendo a prerrogativa de obtenção do primeiro tratamento, sem qualquer custo, junto ao Sistema Único de Saúde, no prazo de até 60 dias contados do diagnóstico. Como o direito à saúde é uma forma de atender ao Princípio da Dignidade da Pessoa Humana, é necessário não apenas previsão legal para a proteção dos doentes, mas que os cidadãos, em geral, tenham acesso às devidas informações sobre os direitos que possuem.Palavras-chave: Neoplasia maligna. Princípio da Dignidade da Pessoa Humana.ABSTRACTThe theme of the research is the legal protection for the victims of malignant neoplasm, which relevance is evidenced by the high number of occurrences of this disease. The objective is to identify the main legal texts that support patients affected by this disease and to verify their effectiveness for what concerns publicizing the benefits and attending to the needs related to health. This is an exploratory research, based on the inductive method, covering bibliographical review about the history of this disease, its emergence, the consequences and the available treatments, to point out, therefore, the State’s performance in the fulfillment of its duties and in the promotion of public health, in particular, with regard to the provisions of Law 12.732/2012 and the benefits listed in the legislation. The research contemplates interviews with people who have undergone oncological treatment funded by the State, according to Resolution 510 (2016), considering that the project was registered on Plataforma Brasil and approved by the Ethics and Research Committee, at Feevale University. As a result, is is possible to say that one of the main texts about protection to the victims of malignant neoplasm is Law 12.732/2012, which brings up the prerrogative of obtaining the first treatment, without any cost, by the Unified Health System, within a deadline of 60 days, counted from the diagnosis. The right to health is a way of complying with the Principle of the Dignity of the Human Person, so not only legal prevision is required for the protection of patients, but also citizens, in general, must have access to information about the rights they have.Keywords: Malignant neoplasm.
