The new social order under emergency decrees: risks to the public management and to the democratic life

Resumo: The emergency decree has been a recurring practice in the public administration which announces the existence of an unmanageable crisis within the management routines. Such an announcement generates legal backing for changing the method of capturing and using public resources as well as the type of socio-political relationship between government authority and the citizens. When the emergency decree ceases to be an exceptional practice and normalizes, regardless of the disasters that justify it, a worrying breach opens that could threaten the pillars of democratic life. This sociological essay focuses on the above problem by analyzing the main aspects highlighted in the recent international debate on the subject. And it illustrates aspects of the dynamics of emergency decrees in Brazil. The results point to the risks that the emergency legislation offers as a triptych mechanism – ethical, practical, and logical-operative – liable to reorient public institutions towards anti-democratic purposes.

Tal anuncio genera respaldo legal para cambiar el método de captura y uso de los recursos públicos, así como el tipo de relación sociopolítica entre la autoridad gubernamental y los ciudadanos. Cuando el decreto de emergencia deja de ser una práctica excepcional y se normaliza, independientemente de los desastres que lo justifiquen, se abre una brecha preocupante que podría amenazar los pilares de la vida democrática. Este ensayo sociológico se centra en esa problemática analizando los principales aspectos destacados en el reciente debate internacional sobre el tema. E ilustra aspectos de la dinámica de los decretos de emergencia en Brasil. Los resultados apuntan a los riesgos que ofrecen los dispositivos legales de emergencia como mecanismo tríptico – ético, práctico y lógico-operativo –, susceptibles de reorientar las instituciones públicas hacia fines antidemocráticos.A decretação de emergência tem sido uma prática recorrente da administração pública, a qual anuncia a existência de uma crise não manejável dentro das rotinas de gestão. Tal anúncio gera um lastro legal para a alteração do modo de captação e utilização dos recursos públicos bem como do tipo de relação sociopolítica entre a autoridade governamental e os cidadãos. Quando a decretação de emergência deixa de ser uma prática excepcional e se normaliza, a despeito de quais sejam os desastres que a justifiquem, abre-se uma preocupante brecha passível de ameaçar os pilares da vida democrática. Este ensaio sociológico focaliza a problemática acima analisando os principais aspectos salientados no debate internacional no assunto e ilustra com aspectos da dinâmica de desastres no Brasil.
