OVERCOMING THE NOTION OF ABSOLUTE RIGHT TO PROPERTY BY THE CONSTITUTIONAL IMPOSITION OF ITS SOCIAL FUNCTION

Resumo: The right of property within the respective economic order according to the 1988 Brazilian Federal Constitution is discussed. The history of this right within Brazilian constitutionalism will be contextualized in its insertion in the current juridical regime in the wake of its intrinsic social function. As a human fundamental right, it is foregrounded first on freedom and then on equality and fraternity which require, as a whole, immediate protection as the Constitution demands. The social and environmental functions of private property reveal the overcoming of its individual stance.

Primeramente, vamos a contextualizar el recorrido de este derecho en la historia del constitucionalismo nacional para, posteriormente, evocarlo en la actual regencia jurídica de la economía frente a su función social intrínseca, balizándose como derecho humano fundamental de primera dimensión – libertad, a las demás dimensiones, cuáles sean, la igualdad – segunda dimensión – y de la fraternidad – tercera dimensión -, que demandan, en conjunto, protección inmediata, conforme prescribe el texto constitucional patrio. Las funciones sociales y ambientales de la propiedad privada revelan la superación de su carácter individual.O presente artigo busca analisar o direito de propriedade na respectiva ordem econômica consoante expressa pela Constituição Federal brasileira de 1988. Primeiramente, vamos contextualizar brevemente o trilhar deste direito na história do constitucionalismo nacional para, posteriormente, evocá-lo enquanto inserido na atual regência jurídica da economia em face de sua função social intrínseca, balizando-o enquanto direito humano fundamental de primeira dimensão - liberdade, às demais dimensões, quais sejam, a da igualdade – segunda dimensão – e a da fraternidade – terceira dimensão –, que demandam, em conjunto, proteção imediata, conforme prescreve o texto constitucional pátrio.
