Resumo: The conception of administrative procedure as a function of Public Administration is consolidated from the Federal Constitution, imposing limits on state power and guaranteeing citizens the right to active participation in administrative decisions. This article aims to demonstrate, based on a bibliographical review and analysis of public access data records, the importance of the topic as a means of reducing legal demands in which the Public Administration figures as a procedural party and whether this contributes to the relief of the Judiciary. Data recorded on the website of the National Council of Justice (CNJ) were analyzed to verify whether there is a relationship between the records and slow and illegitimate action, resulting from the absence of good administrative practices and it was inferred that the Public Administration figures as the biggest litigants in the last ten years, representing a procedural burden of more than half of the cases pending in the country's courts.

O presente artigo tem por objetivo demonstrar, com base na revisão bibliográfica e na análise de registro de dados de acesso público, a importância da temática, como meio de redução das demandas judiciais em que a Administração Pública figure como parte processual e se isso contribui para o desafogamento do Poder Judiciário.
