This article analyzes the right to work as a way of guaranteeing the dignity of the human person, studies the influence of the sociocultural aspect in the work of seniles, examines the affirmative actions proposed by governments, as well as the role of the social function of the company in achieving labor rights of the elderly, in addition to investigating how education interferes with the insertion of this group in the formal labor market. The general objective of this research is to analyze the incorporation of the elderly in the job market, investigating the social, educational and governmental aspects. To achieve this scope, a bibliographical and documentary survey and explanatory field research (TUMELERO, 2020) was carried out. The results found demonstrate that the educational level of the worker is an essential element for his placement in a less precarious way in the productive activity. The lower the level of education, the more likely the elderly are to work informally.
