Resumo: The object of this research was the lack of vacancies and judicialization for access to them in daycare centers in the Metropolitan Region of São Paulo. Interventions by the Judiciary and the Public Defender's Office occurred regularly to promote the realization of the Right to Education. As a consequence of complying with the judicial measures, some daycare centers suffered irregularities in the care module, in relation to the number of babies per caregiver. Overcrowding in the nursery was the subject of this research. From the survey of the initial hypotheses, field research was carried out with a case study. Initial hypotheses: Did the actions of the Judiciary or the Public Defender's Office cause overcrowding in the daycare center? Was there a dialogue between the Judiciary, the Public Defender's Office, the Public Prosecutor's Office with the Department of Education and, as it happened, did the quality of education in the Day Care take as a parameter? Was there an expansion plan for the construction of new daycare centers? Did the Day Care Center maintain a service plan in the overcrowded nurseries? Did the actions of the Judiciary and the Public Defender's Office redesign another pedagogical practice? How did care take place in these nurseries? This case study verified if there were pedagogical consequences due to the lack of vacancies and judicialization. Did you check if there were contributions from the Judiciary, the Public Defender's Office and the Public Ministry with the judicialization? He verified how this dialogue took place. It started from the hypothesis that the insertion of babies, through judicialization, causes pedagogical consequences. To determine the universe of the research, a public daycare center in the Metropolitan Region of São Paulo was selected. This unit for some years has been able to meet demand above capacity, due to judicialization. Two nursery rooms were researched and observed. The subjects were nursery teachers, nursery assistants, management team, families, members of civil society and the Public Defender's Office. The case study included: semistructured interviews; survey of the number of enrollments in nurseries resulting from judicialization; analysis of the Day Care Political Pedagogical Project and the Conduct Adjustment Term (TAC); Note; enrollment; waiting lists and municipal service expansion plan, if any. Las intervenciones del Poder Judicial y de la Defensoría Pública se realizaron periódicamente para promover la realización del derecho a la educación. Como consecuencia del cumplimiento de las medidas judiciales, algunas guarderías sufrieron irregularidades en el módulo de atención, en relación al número de bebés por cuidador. El hacinamiento en el vivero fue el tema de esta investigación. A partir del relevamiento de las hipótesis iniciales, se realizó una investigación de campo con un estudio de caso. Hipótesis iniciales: ¿Las actuaciones del Poder Judicial o la Defensoría del Pueblo provocaron hacinamiento en la guardería? ¿Hubo un diálogo entre el Poder Judicial, la Defensoría Pública, el Ministerio Público con la Secretaría de Educación y, como sucedió, se tomó como parámetro la calidad de la educación en la Guardería? ¿Había un plan de expansión para la construcción de nuevas guarderías? ¿Mantuvo la guardería un plan de servicio en las guarderías superpobladas? ¿Las acciones del Poder Judicial y la Defensoría Pública rediseñaron otra práctica pedagógica? ¿Cómo se realizó el cuidado en estos viveros? Este caso de estudio verificó si hubo consecuencias pedagógicas por la falta de vacantes y judicialización. ¿Verificó si hubo aportes del Poder Judicial, la Defensoría Pública y el Ministerio Público con la judicialización? Verificó cómo se desarrolló este diálogo. Partió de la hipótesis de que la inserción de bebés, a través de la judicialización, provoca consecuencias pedagógicas. Para determinar el universo de la investigación, se seleccionó una guardería pública en la Región Metropolitana de São Paulo. Esta unidad desde hace algunos años ha podido satisfacer la demanda por encima de su capacidad, debido a la judicialización. Se investigaron y observaron dos salas de guardería. Los sujetos fueron maestras de párvulos, auxiliares de guardería, equipo directivo, familias, miembros de la sociedad civil y la Defensoría Pública. As intervenções do Poder Judiciário e da Defensoria Pública ocorreram com regularidade, para promover a efetivação do Direito à Educação. Como consequência do cumprimento das medidas judiciais, algumas creches sofreram com irregularidade no módulo de atendimento, em relação à quantidade de bebês por cuidador. A superlotação no berçário foi objeto desta pesquisa. A partir do levantamento das hipóteses iniciais, foi realizada pesquisa de campo com um estudo de caso. Hipóteses iniciais: As ações do Poder Judiciário ou da Defensoria Pública causaram superlotação na Creche? Existiu diálogo entre Poder Judiciário, Defensoria Pública, Ministério Público com a Secretaria de Educação e, como ocorreu, teve como parâmetro a qualidade da educação na Creche? Existiu plano de expansão para construção de novas Creches? A Creche manteve plano de atendimento nos berçários com superlotação? As ações do Poder Judiciário e da Defensoria Pública redesenhou outra prática pedagógica? Como ocorreu o atendimento nestes berçários? Este estudo de caso verificou se existiram consequências pedagógicas devido à falta de vagas e judicialização. Verificou se houve contribuições do Poder Judiciário, da Defensoria Pública e do Ministério Público com a judicialização? Verificou como se deu esse diálogo? Partiu da hipótese de que a inserção dos bebês, por meio da judicialização, acarreta desdobramentos pedagógicos. Para determinar o universo da pesquisa foi selecionada uma creche pública da Região Metropolitana de São Paulo. Esta unidade há alguns anos realiza o atendimento da demanda acima da capacidade, devido à judicialização. Foram pesquisadas e observadas duas salas de berçário. Os sujeitos foram professores dos berçários, auxiliares dos berçários, equipe gestora, famílias, membros da sociedade civil e da Defensoria Pública. O estudo de caso contou com: entrevistas semiestruturadas; levantamento da quantidade de matrículas nos berçários advindas da judicialização; análise do Projeto Político-Pedagógico da Creche e do Termo de Ajustamento de Conduta (TAC); observação; matrículas; listas de espera e plano de expansão de atendimento municipal se houver. Interventions by the Judiciary and the Public Defender's Office occurred regularly to promote the realization of the Right to Education. As a consequence of complying with the judicial measures, some daycare centers suffered irregularities in the care module, in relation to the number of babies per caregiver. Overcrowding in the nursery was the subject of this research. From the survey of the initial hypotheses, field research was carried out with a case study. Initial hypotheses: Did the actions of the Judiciary or the Public Defender's Office cause overcrowding in the daycare center? Was there a dialogue between the Judiciary, the Public Defender's Office, the Public Prosecutor's Office with the Department of Education and, as it happened, did the quality of education in the Day Care take as a parameter? Was there an expansion plan for the construction of new daycare centers? Did the Day Care Center maintain a service plan in the overcrowded nurseries? Did the actions of the Judiciary and the Public Defender's Office redesign another pedagogical practice? How did care take place in these nurseries? This case study verified if there were pedagogical consequences due to the lack of vacancies and judicialization. Did you check if there were contributions from the Judiciary, the Public Defender's Office and the Public Ministry with the judicialization? He verified how this dialogue took place. It started from the hypothesis that the insertion of babies, through judicialization, causes pedagogical consequences. To determine the universe of the research, a public daycare center in the Metropolitan Region of São Paulo was selected. This unit for some years has been able to meet demand above capacity, due to judicialization. Two nursery rooms were researched and observed. The subjects were nursery teachers, nursery assistants, management team, families, members of civil society and the Public Defender's Office. The case study included: semistructured interviews; survey of the number of enrollments in nurseries resulting from judicialization; analysis of the Day Care Political Pedagogical Project and the Conduct Adjustment Term (TAC); Note; enrollment; waiting lists and municipal service expansion plan, if any.
