Resumo: This research investigates adolescents in conflict with the law at school environment, aiming to identify and discuss the main difficulties they find when returning to their studies, promoting a debate about the aspects of this relationship. The theoretical reference is Edgar Morin Complex Thought, through complexity operators, projection-identification complex and human comprehension as a basis to approach the individuals??? school and social contexts, also to think about social stigmas involved in the socio-educational process they are subjugated. By means of a qualitative study, we used the open interview method with ten adolescents, both sexes, going through socio-educational measure in an open environment of assisted freedom at S??o Bernardo do Campo Socio-educational Service Centre (Case). The results indicated that most of the time the adolescents do not feel themselves belonging to an environment with attitudes that discriminate them, pointing to the need of rethinking the way these individuals are attended at the regular teaching network and about matters beyond the guaranteed right. Different aspects were observed related to the connection between socio-educational measure, school and adolescent in conflict with the law, highlighting the elements involved in the adolescent study (re)insertion, maintenance and continuity, also the acceptance and/or aversion process at school environment. Concluding, this study points to future investigations in socio-educational measures, education and the Right Guarantee System (SGD) context, strengthening these connections, weak before, sometimes ruptured by part of the school team aversion matters, even because of social stigma or judicial determination obligatory. Though, the right to access and permanence in the human person in development condition must be prioritized without any restriction.

El marco te??rico es el pensamiento complejo, de Edgar Morin, que sirvi?? de soporte a la direcci??n, a trav??s de los operadores de la complejidad, del complejos imaginarios y la comprensi??n humana, la escuela y el contexto social en el que se insertan los sujetos, as?? como reflexionar sobre estgimas sociales que impregnan el proceso socioeducativo en el que se presentan. A trav??s del estudio cualitativo se utiliz?? el m??todo de la t??cnica de la entrevista abierta, con la participaci??n de diez adolescentes de ambos sexos que estaban cumpliendo medida socioeducativa en libertad condicional en el Centro de Atendimento Socioeducativo (Case) de S??o Bernardo do Campo. Los resultados de los an??lisis apuntaban a un entorno en el que, com mayor frecuencia, los adolescentes no dan cuenta de propriedade de las actitudes de encuentro que lo diferencian, indicando adem??s la necesidad de replantear la manera en adolescentes se vem em red regular de ensen??nza y reflexionar sobre las cuestiones m??s all?? del derecho garantizado. Se observaron diferentes aspectos que estuvieron de acuerdo en la relaci??n entre medida socioeducativa, la escuela y los adolescentes en conflicto con la ley, destac??ndose las cuestiones que atravesan por la (re) inserci??n, permanencia y continuidad de los estudios, y el proceso de aceptaci??n y/o aversi??n de estos y/o aversi??n de estos adolescentes en la escuela.. Al final de este estudio apunta futuras investigaciones en el marco de las medidas socioeducativas, la educaci??n y dem??s involucradas en el SGD - Sistema de Garant??ia de Derechos, para reflejar las relaciones establecidas entre el adolescente y la escuela, estrechando estos lazos hasta entonces fragilizados, y?? veces que se rompi??, mediante las cuestiones relacionadas de aversi??n por parte del equipo escolar, sea por el estigma social, sea por la obligatoriedad ante la determinaci??n judicial. Sin embargo, cabe resaltar que se debe dar prioridad al derecho de acceso y permanencia en el desarollo de la persona humana sin ning??n tipo de restricci??n.A presente pesquisa investiga e analisa as experi??ncias de adolescentes em conflito com a lei no ambiente escolar, objetivando identificar e discutir as principais dificuldades encontradas por esses adolescentes quando do retorno escolar, promovendo uma discuss??o em torno das nuances existentes nesta rela????o. O referencial te??rico ?? o Pensamento Complexo, de Edgar Morin, que serviu de sustenta????o para abordar, por meio dos operadores da complexidade, dos complexos imagin??rios e da compreens??o humana, o contexto escolar e social em que os sujeitos est??o inseridos, bem como refletir sobre os estigmas sociais que permeiam o processo socioeducativo ao qual est??o submetidos. Por meio do estudo qualitativo foi utilizado o m??todo da t??cnica de entrevista aberta, com a participa????o de dez adolescentes de ambos os sexos que estavam cumprindo medida socioeducativa em meio aberto de Liberdade Assistida no Centro de Atendimento Socioeducativo (Case) de S??o Bernardo do Campo. Os resultados mediante as an??lises apontaram para um ambiente no qual, na maioria das vezes, os adolescentes n??o se percebem pertencentes, por se deparar com atitudes que os diferenciam, indicando ainda a necessidade de repensar a maneira como os adolescentes s??o atendidos na rede regular de ensino e refletir acerca das quest??es para al??m do direito garantido. Foram constatados diferentes aspectos que coincidiram na rela????o existente entre medida socioeducativa, escola e adolescente em conflito com a lei, destacando-se as quest??es que perpassam pela (re)inser????o, perman??ncia e continuidade dos estudos, e o processo de aceita????o e/ou avers??o desses adolescentes no ambiente escolar. Ao final este estudo aponta futuras investiga????es no ??mbito das medidas socioeducativas, educa????o e demais envolvidos no SGD ??? Sistema de Garantia de Direitos, a fim de refletir as rela????es estabelecidas entre o adolescente e a escola, estreitando esses la??os at?? ent??o fragilizados, e por vezes rompidos, mediante as quest??es relacionadas de avers??o por parte da equipe escolar, seja pelo estigma social, seja pela obrigatoriedade diante da determina????o judicial.
