The subject of this article is the injunction warrant and the federal supreme court interpretation. The problem investigate is: the injunction warrant adoption by the Federal Supreme Court and how it’s been applied over the years? The hypothesis to be considered was the injunction warrant efficiency. The general goal is understanding the historical evolution of the injunction warrant by the Supreme Court. The specific objectives are examining the historical context of the insertion of the injunction warrant in the legal system; investigate the effectiveness of the rights determined by the constitutional legislature; evaluate the effectiveness over the years. This article is important due the clarification of historical situations that influenced the regulation of injunction warrant; for the science, because proposes verify the existence of legislative omissions; and to society by the assessment of injunction warrant sufficiency applicability of fundamental rights and guarantees.
