This paper aimed to discuss the existential damage in labor relations based on the constitutional principle of human dignity. The research included the analysis of the appropriateness of compensation towards the civil liability institute, which has been recognized by national courts. The basic precepts of the employment relationship are, among others, the right to dignified existence, health, personality rights, right to rest and leisure, which - combined with the principle of human dignity - express the main fundamental human rights enshrined in the Constitution of 1988. The existential damage is seen by the doctrine as a result institute of employers' attitudes that prevent the continuation or resumption of employees"™ life projects. It follows that the compensation towards the existential damage on the employment relationship is possible, in other words, companies related damages to the worker's existence can and must be punished with compensation to be arbitrated by the judiciary.
