The subject of this work is Parental Alienation and its Legal Framework. Seeking the following question: how shared custody as a mechanism of prevention or possible solution of parental alienation, being able under the light of the legal system, to interrupt the abuse by the alienator, without causing greater psychological damage to the child, having as legal basis the Federal Constitution, the Statute of the Child and Adolescent, the Civil Code, the Code of Civil Procedure, and Law No. 12.318/ 2010 and being observed, in addition, the jurisprudence on the matter. The general objective is to examine the concept of Parental Alienation and the psychic consequences resulting from it with the appearance of Parental AlienationSyndrome. Elaborated through bibliographic research that has as scope the Brazilian judicial system. In order to seek this understanding, authors were consulted who described parental alienation and its legal systems and showed in the work the characteristics of parental alienation, the action of the family and the Justice in seeking to resolve the attitude of some parents in blocking the coexistence of the other parent with the child, almost always causing damage to children who cannot defendthemselves.
