FOR A DIALOGICAL AND ANALOGICAL UNIVERSALITY OF HUMAN RIGHTS

Resumo: The consolidation of mechanisms of international protection for human rights presupposes some sense of universality of rights. On the other hand, the cultural diversity that characterizes the current international community requires respect for plurality. In this debate, there appear to be only the extremes, radical relativism and absolute universalism. Thus, the aim of this paper is to analyze the universality of human rights and if it is possible to prevent it will become a cultural instrument of oppression. Through a literature search, it is an analysis about the meanings of universality and relativity of human rights. After submitting their criticism, we put up a proposal for a universality that considers culture. Finally, we come to the conclusion that the concept of human rights depends on the notion of universality, to some extent. However, considering that the human being is embedded in different cultures, it is necessary a concept of universality that can be performed in a plural way, without imposing a particular form of life.

Por outro lado, a diversidade cultural que caracteriza a atual comunidade internacional exige o respeito pela pluralidade. Nesse debate, aparentemente existem apenas os extremos, o relativismo radical e o universalismo absoluto. Dessa forma, o objetivo do presente artigo é analisar a universalidade dos direitos humanos e se é possível evitar que ela se torne um instrumento de opressão cultural. Por meio de uma pesquisa bibliográfica, fazemos uma análise dos sentidos de universalidade e relatividade dos direitos humanos. Após a apresentação das respectivas críticas, apresentamos uma proposta de universalidade que considera a cultura. Por fim, concluímos que o conceito de direitos humanos depende, em alguma medida, da universalidade.
