Universalism and relativism in debate: the issue of indigenous infanticide

Resumo: The present article aims to discuss the issue of infanticide perpetrated within certain indigenous peoples; for this purpose, the debate is conducted of considering the conflict between universalist and relativist perspectives within the realm of human rights. Additionally, a historical contextualization around this debate was provided to expose the criticisms leveled against these currents to the reader. Preference was given to arguments from the universalist perspective over references brought by relativism but allowing for a reconciliatory path between the two currents. The study regarding indigenous rights was conducted under the analysis of ILO Convention N. 169, as well as influences brought by the Universal Declaration of Human Rights. Lastly, the core of the study focused on the issue of infanticide. The scientific methodology adopted is a descriptive study, based on renowned bibliographic sources on the subject.

Ademais, promoveu-se uma contextualização histórica em torno do referido debate, a fim de expor ao leitor as críticas lançadas em face dessas correntes. Deu-se predileção aos argumentos da matriz universalista em detrimento das referências trazidas pelo relativismo, mas sendo facultada a via conciliatória entre as duas correntes. O estudo referente aos direitos indígenas foi realizado sob a análise da Convenção n. 169 OIT, bem como por influências trazidas pela Declaração Universal dos Direitos Humanos. Por fim, o cerne do estudo gravitou a questão do infanticídio.
