The scope of the Public Ministry in the face of the climate emergency and the deforestation of the Amazon

Resumo: The climate urgency presents itself as a global reality of undeniable planetary interest. The State of Amazonas and the Amazon are elements of interest in the climate urgency topic for what their biome still has to offer the world. Deforestation in the Legal Amazon increases in 2021, and the State of Amazonas contributes to this growth. In this context, the research question is how the Public Ministry can act on the deforestation of the Legal Amazon in the State of Amazonas and contribute to the sustainable development of the region. It seeks to understand the contours of the climate emergency and its relationship with the SDGs of the UN 2030 Agenda; the existence of the right of nature and its compatibility with development and the minimum level of civilization are discussed; and the reality and challenges of the Amazon Public Ministry in the face of deforestation in the State are pointed out. The methodology applied includes research in documentary, legal and bibliographic sources, of an exploratory nature and explanatory character with qualitative analysis. With this, it is expected to present information about the role of the Public Ministry in the implementation of public policies that consolidate the foundations and objectives of the Democratic State of Law in the defense of a healthy and sustainable environment in State of Amazonas.

O Amazonas e a Amazônia são elementos de interesse na pauta da urgência climática pelo que o seu bioma ainda tem para oferecer ao mundo. O desflorestamento da Amazônia Legal aumenta, no ano de 2021, e o Estado do Amazonas contribui para esse crescimento. Nesse contexto, a questão de pesquisa é como o Ministério Público pode agir sobre o desflorestamento da Amazônia Legal no Estado do Amazonas e contribuir para o desenvolvimento sustentável da região. Busca-se a compreensão dos contornos da urgência climática e sua relação com os ODS da Agenda 2030 da ONU; discute-se a existência do direito da natureza e sua compatibilidade com o desenvolvimento e o patamar mínimo civilizatório; e apontam-se a realidade e os desafios do Ministério Público Amazonense diante do desflorestamento no Estado. A metodologia aplicada contempla a pesquisa em fontes documentais, legais e bibliográficas, de natureza exploratória e caráter explicativo com análise qualitativa.
