Human rights education in Brazilian higher education: An overview of the theoretical and normative elements

Resumo: This paper aims to present an overview of the theoretical and normative foundations of Human Rights Education in Higher Education, with special emphasis on the constitutive process of this educational practice in the Brazilian context. To this purpose, the authors sought to understand the context in which HEIs are inserted – especially public universities – as well as the theoretical foundation of HRD present in academic literature and in the main Brazilian instruments and norms. As main results, it is possible to highlight the following: (a) HRD, as a recent educational practice, is linked to the perspective that the social commitment to be assumed by public universities consists in the production of basic research and the formation of critical knowledge; (b) this practice, as an essential part of the set of fundamental rights, aims to prevent violations, to inform and to make known the rights by which we are subjected; (c) in Higher Education, it is established, mainly, in the National Plan for HRD, as well as in the National Guidelines for HRD, constituting an axis of action by which Brazilian universities are required to act.

Con este fin, buscamos comprender el contexto en el que se insertan las instituciones de educación superior, especialmente las universidades públicas, así como los fundamentos teóricos sobre EDH presentes en la literatura académica y en los principales instrumentos y regulaciones del Sistema Nacional de Derechos Humanos. Como resultados principales, es posible resaltar lo siguiente: (a) EDH, como práctica educativa reciente, vinculada a la perspectiva de que el compromiso social que deben asumir las universidades públicas consiste en la producción de investigación básica y la formación de conocimiento crítico; (b) Esta práctica, que es una parte esencial del conjunto de derechos fundamentales, tiene como objetivo prevenir violaciones, informar y dar a conocer los derechos a los que estamos sujetos; (c) en el la Educación Superior, esto es positivo, principalmente, en el Plan Nacional de EDH, así como en las Directrices Nacionales para la EDH, constituyéndose como un eje de acción por el cual las universidades brasileñas deben actuar.Este artigo tem como objetivo apresentar um panorama sobre os fundamentos teóricos e normativos da Educação em Direitos Humanos (EDH) no âmbito do ensino superior, atribuindo especial destaque ao processo constitutivo desta prática educativa no contexto brasileiro. Para tanto, buscou-se compreender o contexto pelo qual as Instituições de Ensino Superior (IES) estão inseridas – em especial as universidades públicas –, bem como a fundamentação teórica acerca da EDH presente na literatura acadêmica e nos principais instrumentos e normativas brasileiras.
