Dictatorship and extraordinary powers: a debate between classical republicanism and liberalism in the context of the war between Chile and the Peruvian-Bolivian Confederation (1836-1839)

Resumo: The paper analyzes the political discourses surrounding the implications of the extraordinary powers and states of siege present in the Chilean 1833 Constitution. The research seeks to highlight the tension that emerges between classical republican and liberal thoughts from the justification of “emergency powers” outlined in the 1833 constitutional order. In this respect, the political and ideological debate that erupted in Chile’s public sphere in 1839 by virtue of the implications of the special powers” implemented during the war between Chile and the Peruvian-Bolivian Confederation will be examined. The hypothesis is that from this public debate, it is possible to observe the deployment of classic Liberal Republican political discourse that discusses constitutional effects of extraordinary powers under exceptional circumstances. The materials used to rebuild these political speeches are contemporary press and parliamentary motions.

La investigación busca iluminar la tensión que emerge entre el pensamiento republicano clásico y liberal a partir de la justificación de los  “poderes de emergencia” en el orden constitucional. Para este objetivo se analizará el debate político-ideológico que irrumpió en la esfera pública chilena en 1839 por las implicancias de las “facultades extraordinarias” implementadas durante la guerra entre Chile y la Confederación Perú-boliviana. La hipótesis plantea que a partir de este debate público es posible observar la trayectoria de un lenguaje político republicano clásico a uno liberal, evidenciado en la discusión sobre los mecanismos y alcances constitucionales ante circunstancias de excepcionalidad. El material utilizado para reconstruir estos discursos políticos es la prensa de la época y las mociones parlamentarias.O artigo analisa os discursos políticos desdobrados em torno das implicações dos poderes extraordinários e os estados de sítio presentes na Constituição Chilena de 1833. A pesquisa procura iluminar a tensão que emerge entre o pensamento republicano clássico e o liberal a partir da justificação dos “poderes de emergência” na ordem constitucional. Com esse objetivo, será analisado o debate político-ideológico que surgiu na esfera pública chilena em 1839 pelas implicações dos “poderes extraordinários” implementados durante a guerra entre o Chile e a Confederação Peru-Boliviana. A hipótese é que a partir desse debate público é possível ver uma passagem da linguagem política republicana clássica para uma mais liberal, evidenciada na discussão sobre os mecanismos e âmbito constitucional das circunstâncias excepcionais.
