Resumo: Contemporary society faces multiple challenges because of the popularization of internet and social movements, bringing difficulties to Law as an institution to play its role inside society and through connections with other powers – in case, legislative and executive. The very word ‘power’, enlightning the difficulty to coming into a concept, brings out questions that fragilizes current social organization, denouncing ancient roots to problems faced in contemporary times. Therefore, and having as a basis a historical panorama developed throughout the thesis, the main objective of this research is to analyze the envy problem and how this phenomenon is connected with a justice theory, shaping along the centuries what society understands by ‘fair’ and ‘unfair’. This context, obvious, regard to the very judiciary phenomenon, which is approached through the concepts of mimetic envy and sense of unfairness, besides other related feeling, such as indignation. In order to be possible to relate envy and Law, with all the perspectives involved, it is needed to bring authors such as Foucault, Rawls, Klein, Girard and Ferraz Junior, going through related subjects to make possible the comprehension about the way that envy influences the sense of fairness and unfairness – and how it occurred in many ways among history. We begin with Rawls’ Justice Theory to visualize how the author (doesn’t) include envy in his ideal of justice and, through questions and problems that comes from this lack of prevision, the research works with Aristotheles and others to see the advance of envy in history and the phenomenons that, when in contact with it, were able to shape envy and justice until the contemporary society – which still mirrors in its fellow men to constitute its individuals, but which demonstrates a high sense of injustice, especially in view of the most recent nuances related to the Judiciary. In view of the above, the objective of this thesis is to analyze all these phenomena to question, in addition to the relationship between envy and law what can be done in contemporary society to solve the incompleteness and incongruities that have been denounced by individuals through the internet – and, above all, the notion of envy itself.

La misma palabra 'poder', denunciando la dificultad de conceptualizarlo, trae a colación cuestiones que debilitan la organización de la sociedad actual, denunciando raíces ancestrales para problemas enfrentados en la contemporaneidad. Así, y con base en el panorama histórico desarrollado a lo largo de esta tesis, el objetivo de esta investigación es analizar el problema de la envidia y cómo este fenómeno se imbrica en la teoría de la justicia, configurando a lo largo de los años lo que la sociedad entiende por 'justa' y 'justa'. injusto'. Este contexto, obviamente, está relacionado con el propio fenómeno judicial, que se aborda a través de los conceptos de 'envidia mimética' y 'sentido de injusticia', además de otros sentimientos relacionados, como 'indignación'. Para poder relacionar la envidia y el Derecho, con todos los matices inherentes a este escenario, es necesario hacer uso de autores como Foucault, Rawls, Klein, Girard y Ferraz Junior, abordando temas afines al tema principal para posibilitar una comprensión de cómo la envidia influye en el sentido de la justicia y la injusticia, y cómo esto ha sucedido de diferentes maneras a lo largo de la historia. De esta manera, se parte de la Teoría de la justicia de Rawls para posibilitar la visualización de cómo el autor (no) inserta la envidia en su ideal de justicia y, a través de los interrogantes y problemas que surgen de esta imprevisión, la investigación trabaja con Aristóteles y otros autores para visibilizar el avance de la envidia en la historia y los fenómenos que, al entrar en contacto con ella, sirvieron para moldear tanto la envidia como la justicia hasta llegar a la sociedad contemporánea, que aún se refleja en sus pares para constituir a sus individuos, pero lo que demuestra un agudizado sentido de injusticia, especialmente frente a los matices más recientes relacionados con el Poder Judicial. En vista de lo anterior, el objetivo de esta tesis es analizar todos estos fenómenos para cuestionar, además de la relación entre la envidia y el Derecho, qué se puede hacer en la sociedad contemporánea para solucionar las incompletudes e incongruencias que han sido denunciadas por los individuos a través de Internet - y, principalmente, la noción misma de envidia. A sociedade contemporânea enfrenta diversos desafios em razão da popularização da internet e dos movimentos sociais, trazendo dificuldades para que o Direito enquanto instituição desempenhe sua função no seio da sociedade e através de articulações com outros poderes – no caso, o Legislativo e o Executivo. O próprio vocábulo ‘poder’, denunciando a dificuldade em conceituá-lo, traz à baila questões que fragilizam a organização da sociedade atual, denunciando raízes antigas para problemas enfrentados na contemporaneidade. Dessa forma, e tendo como base o panorama histórico desenvolvido ao longo da presente tese, o objetivo dessa pesquisa é analisar o problema da inveja e como esse fenômeno está imbricado na teoria da justiça, moldando ao longo dos anos o que a sociedade entende por ‘justo’ e ‘injusto’. Esse contexto, por óbvio, guarda relação com o próprio fenômeno judiciário, o que é abordado através dos conceitos de ‘inveja-mimética’ e ‘senso de injustiça’, além de outros sentimentos correlatos, como a ‘indignação’. Para que seja possível relacionar a inveja e o Direito, com todas as nuances inerentes a esse cenário, é preciso lançar mão de autores como Foucault, Rawls, Klein, Girard e Ferraz Junior, perpassando temas relacionados ao assunto principal para possibilitar a compreensão sobre a forma como a inveja influencia no senso de justiça e de injustiça – e como isso se deu de diversas formas ao longo da história. Dessa forma, parte-se da Teoria de Justiça de Rawls para possibilitar a visualização de como o autor (não) insere a inveja no seu ideal de justiça e, através dos questionamentos e dos problemas que advêm dessa falta de previsão, a pesquisa trabalha com Aristóteles e outros autores para visualizar o avanço da inveja na história e os fenômenos que, ao entrarem em contato com ela, serviram para moldar tanto a inveja quanto a justiça até chegar na sociedade contemporânea – que ainda se espelha nos seus semelhantes para constituir seus indivíduos, mas que demonstra um elevado senso de injustiça, especialmente tendo em vista as nuances mais recentes relacionadas ao Poder Judiciário.
