Resumo: The fundamental rights enshrined affirmed in the 1988 constitutional text limit and control the performance of public authorities, to guarantee a dignified life for citizens. The realization of these rights is linked, in many cases, to the implementation of public policies by the State. However, several factors, ranging from the scarcity of financial resources to the omission itself, compromise the Government ability to respond. Thus, there is a significant growth in the performance of the Judiciary in matters pertaining to the sphere of action of the Executive Power. Thus, based on the Schmidt-Assmann theoretical conception of the impulse of fundamental rights on Administrative Law and Public Administration, the present work aims to identify the reflexes of the judicialization of public policies in the Executive Branch and in the promotion of the universality of social rights, with emphasis on health and education services.

A efetivação destes direitos está atrelada, em muitos casos, a implementação de políticas públicas pelo Estado. No entanto, fatores diversos, que vão desde à escassez de recursos financeiros até a própria omissão, comprometem a capacidade de respostas da Administração. Deste modo, nota-se o crescimento expressivo da atuação do Poder Judiciário em questões atinentes à esfera de atuação do Poder Executivo.
