The present work will focus on the Complementary Law nº 123/2006 and on the benefits attributed to micro and small companies in the public bidding process. The main mission of this study will be to examine Section I (arts. 42 to 49) of the aforementioned Complementary Law, analyzing the favored treatment given to micro and small entrepreneurs, as well as its constitutional, doctrinal and jurisprudential basis for this procedure. The issue of promoting national development will also be the subject of much debate in this study and, for that, the third legal purpose of public bidding will be discussed, already brought by Law nº 8.666/93 (Former Bidding Law) and reproduced by Law nº 14.133/21 (New Bidding Law). As a summary of the conclusions reached, the result will be that the application of the legal favor attributed to micro and small companies is not a mere liberality of the legislator, but an order given by the Federal Constitution itself, in the sense of stimulating the micro and small entrepreneurship in Brazil
