Resumo: It´s reasonable to say that a raising awareness of our people concerning their rights had rosen continually since 1988, when a new Federal Constituiton was launched in connection with such fact a hiking demand for litigation stays in course. For this reason brazilian judicial branch has met great challenges to meet it mainly goal which is apply the law. Thus this paper has the intention to present other solutions than litigation to settle disputes out of the courts, the Alternative Dispute Resolutions (ADR) nowadays are the mainly effort made by government and public entities to aim other solutions for civil conflicts. This paper will analyze this new methods to solve disputes and how they can contribute to the State solving conflicts in a more equal and worthy way

This paper will analyze this new methods to solve disputes and how they can contribute to the State solving conflicts in a more equal and worthy wayO presente trabalho tem por objetivo apresentar possíveis soluções para a dificuldade da prestação jurisdicional enfrentada pelo Poder Judiciário, que em razão de vários fatores, decorrentes da conscientização da sociedade em relação aos seus direitos, após a Consituição Federal de 1988, trouxeram como consequência, o crescente aumento de conflitos de interesses e busca ao acesso à justiça. Atualmente, são evidenciados esforços da esfera pública e privada para oferecer à população, opções de resolução para seus problemas, pela via autocompositiva, heterocompositiva, pela esfera consensual ou adjudicada, de modo a encontrar o melhor mecanismo apto para superar o dissenso. À frente deste cenário, a proposta do trabalho se alicerça no estudo dos meios alternativos de solução de conflitos, como modelos postos à colaboração do Poder Estatal para promover o término dos litígios, de forma mais digna e equânime, para todos os envolvidos.
