This study aims to analyze the concept of Public Treasury, its procedural prerogatives and its position when it integrates the passive pole of the lide in certain special situations. It sought to present a historical approach, collating the prevailing understandings in light of the Code of Civil Procedure of 1973 and the current ones under the approach of the Code of Civil Procedure of 2015. Also, it was intended to present the concept of legal fees, the mechanisms existing in the current Code for the purpose of their fixation - succumbencial - in the lawsuits against the Public Treasury. Finally, the problem was faced with the possibility of receiving such fees in an autonomous manner in these demands, making an analysis all the way covered in the scope of the Federal Supreme Court, including the opinions and debates held, until the approval of the Binding Summary 47, which, as it turned out, failed to satisfactorily pacify, in the light of that instrument, the question posed
