Resumo: Brazilian Law No. 13,303/2016, which created the legal status of state-owned enterprises, established three hypotheses for contracting without bids: unenforceability of bidding, waiver of bidding and non-applicability of bidding. The inexistence of bidding and the waiver of bidding followed the models adopted by the Brazilian General Bidding Law (Law No. 8,666/1993), with a few changes. The inapplicability of bidding, foreseen by art. 28, §3, of Brazilian Law No. 13,303/2016, was an innovation brought by law, even though it already had doctrinal and jurisprudential understandings in this regard. The present paper will analyze the legal institute of the inapplicability of bidding, its hypotheses of incidence and the doctrinal discussions on the subject
