The current work seeks to shed some light into the need to discuss the crime of psychological violence against women, focusing on the analysis of what the legislator achieved with the inclusion of article 147-B in the Penal Code through Law nº 14.188/2021. To be able to do that, important historical facts in criminal legislation were rescued to highlight the asymmetric treatment offered to the female gender by Brazilian society and, consequently, by the legislator. It was observed with the study of the phrasing of article 147-B that certain scientific elements in the article do not find clear concepts in the Law, therefore two main academic premises were identified that currently try to define and explain the emotional damage and the psychic damage. For what was canvassed with the research, it is possible to state that the phrasing prepared by the legislator did not favor its application in the Judiciary, so jurisprudence will be left to standardize the subject - constantly, it is know - or for the legislator to propose a reformulation of the criminal article to remedy adversities faced in its application
