The present work has the scope of the study the issue of administrative impropriety in the bidding in Brazil, considering aspects that are relevant and current First we will treat of the tender, and elaborating on background, definition, general principles, modalities and types, as well as about the exceptions to the general duty to bid. Then, we will provide administrative impropriety, its concept, peculiarities, and polemics cloaked in the Law 8429/1992, to after treat the impropriety itself in the Bidding, which will be the core of the development of this monograph. Finally, we will discuss the responsibility of the administrative authority and the applicant of expenses, of the bidding commission and of the auctioneer, of the auditor and of the contractors
