Declaration embargoes are relevant importance of action in civil proceedings as fit and suitable instrument to extirpate omission, contradiction and obscurity, able to macular or prevent fulfillment of the embargoed decision. However, it is true that, sometimes, the clarification remedy goes beyond its borders and hypothesis no place beyond the permission in Article 535, of the Civil Procedure Code. Based on this premise, this article aims to identify the reasons that lead giving effect of amending and infringing judged the requests for clarification, and the possibility of its provision by the judging body, aimed mainly at swift and effective prosecution. It respects, thus, the indelible principle of reasonable duration of the process without the need for bringing another resource with the same purpose already recognized atypically in the aforementioned remedy under discussion
