Da coisa julgada e seus limites na ação civil pública

Resumo: The present work focuses on presenting, in a schematic and practical way, the basic notions necessary to understand the theme, namely, the collective judged thing and its limits, with observance of the Brazilian collective microsystem and its legal rules. In order to introduce the work, a brief historical overview was elaborated about the emergence of collective action and its end, as well as its forms foreseen throughout the Brazilian legal system. Next, a general overview, however, is presented, which is duly specific about public civil action, in order to understand the theme of the present work, referring to the species of collective rights and to the principles of collective procedural law that should lead to all collective actions . Lastly, and finally entering the theme, we discussed the collective thing, considering its current panorama, both jurisprudential and doctrinal, in addition to the practical concern of limiting the decision, taking into account the time spent to reach the collective guardianship sought, as well as their social and economic function

Para introduzir o trabalho, inicialmente, foi elaborado um sucinto panorama histórico acerca do surgimento da ação coletiva e, seu fim, bem como suas formas previstas em todo o ordenamento jurídico brasileiro. Em seguida, é apresentado um panorama geral, contudo, devidamente particularizado acerca da ação civil pública, a fim de compreender o tema do presente trabalho, fazendo referência as espécies de direitos coletivos e aos princípios do direito processual coletivo que devem conduzir todas as ações coletivas.
