Resumo: This dissertation deals with the contract of life insurance and suicide, especially with regard to the rule expressed in Art. 798 of the Civil Code. Through the methods of interpretation of the rule then known, is criticized constructively, the current stance taken by Justice Supreme Court and much of the doctrine in relation to the division of premeditated suicide (voluntary) and unintended (inadvertent) and also the requirement of presentation of evidence by de insurance company for the purposes of payment of the insured benefit.
