Resumo: This study aims to demonstrate the possibility of matching paternity leave with maternity leave, so that the parent or adopter may spend the first months of life of yours with this, as well as helping your wife or partner who is in a state of physical frailty and metal, with a focus on scholars of opinion in Labor Law and Constitutional Law, that elaborate theories and opinions, and teach in the sense that the rights of employees must be equally, always seeking the dignity of the human person and without discrimination, be it any kind, analyzing even those who fit the employee's pay during the period in which it is the enjoyment of paternity leave, including the analysis of the constitutional and fundamental rights principles, as well as in labor and constitutional jurisprudence, converging with the opinion of the aforementioned scholars, concluding that it is fully possible to equate the paternity leave with maternity leave
