This work aims to demonstrate that the complex environmental issues affecting more heavily the vulnerable portion of the population, because of that Public Defense must strengthen its presence in this area. 1. The work will start with the context in which it operates the ecological crisis. 2. Studies and historical facts will be presented culminating in the notion of Environmental Justice as well as on the ecological distributive conflicts around the world, called the Environmentalism of the Poor. 3. The constitutional foundations of the right to an ecologically balanced environment, as diffuse law, as well as their relationship with the principle of equality, particularly considering the occurrence of indirect discrimination against vulnerable, economically and socially. 4. Finally, the legitimacy of the Public Defense for the protection of diffuse rights, with an emphasis on decision of the Supreme Court, in the judgment of the declaratory action of unconstitutionality n. 3469 / DF, and a brief analysis on the challenges of performance of the Public Defender in the face of environmental issues
