In Roman-Germanic system, jurisprudence has always had a secondary role as a source of law, however, especially in Labor Law, jurisprudence, especially the consolidated by the Superior Labor Court, became an important tool for defining the conduct of the persons involved and it is undeniable that substantial changes in the consolidated understandings cause great impact on society. With that in mind, it will be discussed the condition of the jurisprudence as a source of labor law, presenting the traditional and the modern current concept on the subject. Then, will address the issue of legal certainty in Brazilian law, seeking to clarify the scope of its concept. After that, using the legal aspects of such analyzes, an approach of the effects of jurisprudence in time, studying how changes in their concepts would be apply in legal world, especially those related to retroactivity of the consolidated understandings of the Superior Labor Court
