This study intended to analyze the relationship between the process of memory formation and the methods used to obtain evidence of the recognition of people and things, as well as testimonial evidence. It is recognized that the mnemonic process is subject to countless variants, externalities and internal influences, which end up contaminating and suggesting it, distorting the facts experienced by witnesses and victims. In this area, the so-called False Memories come into play, which will be duly presented in the study, expressing their implication in these means of proof. The so-called psychology of testimony must be recognized, given the great importance of testimonial evidence and the recognition of people in criminal proceedings. At first, there will be a presentation of doctrine and case law on testimonial evidence and the recognition of people and things; then there will be an interdisciplinary presentation involving psychology and law; finally, there will be an analysis of the process of memory formation and the judicial errors arising from its fallibility, to be illustrated with the presentation of brief real cases
