The focus of this monography is to study the sole paragraph of Article 741 of the Code of Civil Procedure. We sought to examine the sole paragraph of Article 741, Code of Civil Procedure in the light of the principles of legal certainty and supremacy of the Constitution. The study aims to examine the doctrinal and jurisprudential debates about the embargos as an instrument to prevent the execution sentence against the Constitution. The aspects highlighted are the source, the basis, the constitutionality and applicability of article. In addition, this study has the intention to show the new picture of the issue in the face the Project of the New Code of Civil Procedure. The analysis of the matter showed that the legislature has advanced toward the fulfillment of the principle of legal certainty. We noted also the importance of interpretation of the rules under study be directed to preserve legal certainty
