Theme very controversial in doctrine and jurisprudence, which has been growing before the Labor Court is the request to reverse the burden of proof along the lines of Article 6th of the Consumer Protection Code. Without a doubt, the question is governed by Article 818 of the Consolidation of Labor Laws and does not provide for reversal. However, the issue is growing in labor demands, and the authors call for the reversal of the burden of proof that they had to produce. In traditional courts, for example, the 2nd Region, most of its components, as a rule, with few exceptions, do not apply the reversal of the evidential burden. But courts in other regions of Brazil, tend to apply a reversal of the burden of proof on the grounds, among others, which should be facilitated access to justice. We will have to face in our work the question: "once held the reversal of the burden of proof, what would be the appropriate remedy for the reversal, if it is not reasonable for interlocutory appeal in the labor process to attack decision interlocutory. So, we will seek to demonstrate the work the applicability of this request to reverse the burden of proof
