The new Civil Procedure Code, considering not only the importance of giving concreteness to the constitutional principles of effective judicial protection and promptness (art. 5, XXXV and LXXVIII, of Federal Constitution of 1988), in order to create mechanismsto ensure urgent situations that can not wait for the delivery of the final protection to the end of the process without putting at risk the very protection of the substantive right, but also the need to discourage the filing of unnecessary procedures without removing the parties the possibility to obtain, if they wish, full cognition on the object of the dispute, it ended up predicting, explicitly, the procedure of advance relief requested in previous character and the stabilization technique of early relief granted by this procedure.In this sense, this paper aims to analyze the procedure of anticipated judicial protection requested in antecente character under the new Civil Procedure Code, highlighting the various doctrinal interpretations regarding controversial issues that emerge from the interpretation of law articles in the Civil Procedure Code. To obtain the results, it used theoretical and documentary research, which used the doctrine and jurisprudence relevant to the topic. It can be concluded, with the present study, that the procedure under consideration gives rise to meet primarily the claimants seeking the protection of their rights through a due process, fast and effective. Therein lies the importance of studying this instrument
