Resumo: The new Code of Civil Procedure promoted important changes in the Brazilian civil procedural law, with the objective of guaranteeing the realization of individual and collective rights. One of the most important changes involved the limitation of the possibility of the interlocutory appel in article 1,015. Several analyzes have emerged regarding the nature of that list, for which the theme was respected for legal reasons. The present work seeks to study the applicability of the taxation thesis mitigated by the national Courts, through doctrinal research and jurisprudence to identify a possible consensus. At the end, considerations were made on the reflectionO novo Código de Processo Civil promoveu importantes modificações no sistema processual civil brasileiro, com o objetivo de garantir a concretização dos direitos individuais e coletivos. Uma das mais importantes alterações envolveu a limitação das hipóteses de cabimento do agravo de instrumento no art. 1.015. Surgiram diversas discussões a respeito da natureza do referido rol, motivo pelo qual o STJ fixou o Tema 988. Ao contrário do que era esperado, novas questões surgiram, uma vez que a admissibilidade do agravo ficou refém da discricionariedade e da insegurança jurídica. O presente trabalho busca estudar a aplicabilidade da tese da taxatividade mitigada pelos Tribunais pátrios, por meio de pesquisas doutrinárias e jurisprudências, a fim de identificar eventual consenso.
