This research exposes the gap existing between the ordinary law, the public administration and normativity, wich manifests itself through internal norms. When the highest degree of the Judiciary Labour, Tribunal Superior do Trabalho, edits these norms, eventually attach all the different kind of decisions adjudicated on the minor courts in Brazil, resulting on a prejudgments. This way, according to the issue of Precedent 448 of Tribunal superior do Trabalho, which means that the payment of the Additional for Unhealthy Telemarketing Operators depends forecast in the regulatory provision 15 of the Ordinance No. 3.214/78 Ministry of Labour. So with the research, it sought to highlight the underprivileged position of the worker, even when subjected to unhealthy condition, which entails payment of additional above, ends up not enjoying the benefit at the lack of regulatory foresight. Methodologically we used the literature by reading legal articles, specialized national doctrine and jurisprudence of our courts that deal with the matter.
