In a company, the liabilities of members for their liabilities are, as a rule, limited to the amount they wish to contribute to the share capital, where the personal assets of each partner are distinct from the assets of the company, so the assets of the company should not be confused with the equity of its partners. There are legal exceptions, where fraud in the management and social objective of the company is proven. In relation to the Labor Court there is a peaceful question in the doctrine and jurisprudence that, insolvent the juridical person, the partners respond with their assets by the debts contracted by it. The general objective of the research work was to address the Disregard of Legal Personality in the Code of Civil Procedure and its reflexes in the labor reform. The research was bibliographical, with a review of the literature through the use of books and articles in specialized journals, addressing the concepts of Labor Law, its principles and its execution in the labor process, discussing the legal personality, employer and company, having as focus of study the individual company and finally; the discussion about the Disregard of Legal Personality, involving the origin of the theory, its application in Brazil and the responsibility of the members and administrators in the society and the Disconsideration of the Legal Personality of the Code of Civil Procedure and its reflexes in the labor reform
