Resumo: | The objective of this paper is to present and open paths for discussion about the existence of psychopathic personality in different individuals in the society, especially those convicted for the practice of very serious crimes. Are listed the previous studies on the subject, the names received over the years, the possible causes – such as hereditary and environmental influences – and yet, the tests that can be used to recognize the main features in psychopathic individuals, from early childhood to adulthood, such as aggressiveness, irresponsibility, lack of empathy, lack of remorse, lack of guilt in relation to their antisocial behavior and inability to learn from punishment and offenders to modify their behavior. Controversy exists on the very concept of psychopathy, if is considered as a mental illness or a personality disorder. And in continuity, the issue of responsibility of psychopaths to the legal system, if they are in their full mental faculties to understand the wrongfulness of crimes committed and then, to be responsible for them. The possible treatments that can be applied, such as group therapy, biological therapies and foremost, prevention, still in childhood, so early symptoms of conduct disorder are diagnosed, to prevent it from developing into a possible anti-personality personality disorder and eventually to a framework of psychopathy. And at the end, which measures the Judiciary should or could take, so that these individuals, highly dangerous, does not recur and would not be always a threat to society as a whole, even though there is no possibility of cure for psychopathy until this moment |

São elencados os estudos já realizados sobre o tema, as denominações recebidas ao longo dos anos, as possíveis causas – como influências hereditárias e ambientais – e ainda os testes que podem ser utilizados para reconhecer as principais características psicopáticas nos indivíduos, desde a infância até a idade adulta, tais como: agressividade, irresponsabilidade, falta de empatia, ausência de remorso, ausência de sentimento de culpa em relação ao seu comportamento antissocial e a incapacidade de aprender com a punição e de modificar seus comportamentos transgressores. Há ainda a polêmica existente sobre o próprio conceito da psicopatia: considerada uma doença mental ou um transtorno de personalidade. E em continuidade, a questão da imputabilidade dos psicopatas perante o ordenamento jurídico: se estariam dentro de suas plenas faculdades mentais para compreender a ilicitude dos crimes cometidos e, assim, serem responsáveis pelos mesmos. Os possíveis tratamentos que podem ser aplicados, como terapias em grupo, terapias biológicas e, principalmente, prevenção, ainda na infância, assim que os primeiros sintomas de transtorno de conduta forem diagnosticados, para evitar que o mesmo evolua para um possível transtorno de personalidade antissocial e posteriormente, para um quadro de psicopatia.
