Resumo: This study aimed to understand the challenges regarding the framework of the contract formalized through the platform provided by the AIRBNB. For that, the bibliographical research was used as a method of collecting data, through the content raised in the theoretical reference on points similar to the lease contract for the season regulated by the Law of Tenancy and the means of accommodation normalized in the General Law of Tourism. From the analysis of these data it can be seen that the contract is similar in nature to both institutes and that if a service is carried out together with the lease it can be classified as a means of hosting. We seek to present the main federal projects pertinent to the theme as a solution to the classification of the nature of this contract

Para tanto, foi utilizado como método de coleta de dados a pesquisa bibliográfica, através do conteúdo levantado no referencial teórico sobre os pontos similares ao contrato da locação para temporada regulada pela Lei do Inquilinato e os meios de hospedagem normatizados na Lei Geral do Turismo. A partir da análise destes dados pode-se perceber que o contrato possui natureza assemelhada de ambos os institutos e que se for realizado serviço junto a locação poderá ser classificado como meio de hospedagem.
