Resumo: The present study is an analysis of the procedural contract due to the promulgation of the new Code of Civil Procedure (Law 13,105 of March 16, 2015) regarding its existence, validity and legal and doctrinal limits aspects. The work is divided as follows: primary analysis of the theory of the legal fact in the legal system in order to perceive the institute of the procedural contract, including in this item the procedural facts and acts; II) the definition and comprehensiveness of the procedural contract, making a comparison between the current and past codes to verify the different ways of handling the subject; III) procedural contract elements; IV) procedural contract requirements; and V) procedural contract limits.
