Resumo: The study aims to analyze the negative precedent established by the Superior Tribunal de Justiça (Brazilian Superior Court) in a case in which it was discussed the post consumption liability of a beverage company. Therefore it is indispensable to comprehend the evolution of environmental consciousness and the modern perspective of sustainable development that considers economic, social and environmental aspects. The paper handles important principles that lead Brazilian environmental law and its protection mechanisms foreseen in the Solid Residues National Policy. It is essential to understand these mechanisms and their liability systems in order to achieve effective decisions regarding the matter. Environmental damages are mostly irreversible and do not receive adequate legal tutelage because financial compensation is not able to return the environment to its natural equilibrium. That said the Judiciary has a fundamental role in setting the understanding that shall conduct to the best interpretation of environmental legislation

Para tanto, é imprescindível compreender a evolução da consciência ambiental, culminando na perspectiva moderna de desenvolvimento sustentável, englobados aspectos econômicos, sociais e ambientais. Demonstrar-se-á importantes princípios que norteiam o direito ambiental brasileiro, cujos ditames influenciaram os modernos institutos de preservação ambiental previstos na Política Nacional de Resíduos Sólidos. Entender esses institutos e os sistemas de responsabilização relativos a eles é essencial para se proferir decisões eficazes com relação à matéria. Isso porque o dano ambiental, na maioria das vezes irreversível, não recebe a tutela legal adequada, tendo em vista que somente a compensação financeira não retorna o meio ambiente ao seu estado de equilíbrio.
