Resumo: The present work aims to demonstrate the applicability of the theory of liability for loss of a chance in labor law. So, presents a view of the general theory of liability, as well as characterizing the general conditions necessary for there to be a duty to repair. Discusses the concept and legal nature of the loss of chance, and its origins in comparative law and Brazilian. Also aims to verify the applicability of the theory in the various contract phases - pre contract; contractual and contractual post - by presenting judged for each phase of the contract, in the light of missed chances by the employee in order to collaborate with the insertion of the Institute on a day to day labor relations. Finally, elucidates the mode of quantification of the loss of chance presenting the theories of the reduction coefficient and the theory of difference

Assim, apresenta uma visão da teoria geral da responsabilidade civil, bem como caracterizando os pressupostos gerais necessários para que haja o dever de reparar. Aborda o conceito e natureza jurídica da perda da chance, e suas origens no direito comparado e brasileiro. Visa ainda verificar a aplicabilidade da teoria nas diversas fases contratuais – pré contratual; contratual e pós contratual - com a apresentação de julgados para cada fase do contrato, à luz das chances perdidas pelo empregado, de forma a colaborar com a inserção do instituto no dia a dia das relações trabalhistas.
