The present study aims at approaching the application of the arbitration in the individual Labor Law. This study consists of a revision of the doctrine and the jurisprudence belonging to the theme. At the end of the research the conclusion has been that there is no controversy about the use of arbitration in collective law as its application is authorized by the Federal Constitution. In spite of the authorized application in the collective scope, the Arbitration Law says that the institute applies to the regulation of the available assets rights, which brings some difficulty in the use of arbitration in the individual scope of the Labor Law due to the fact that this special segment of the right is submitted to nuclear principles, specifically the Protective Principles and the Inalienability ones, which are approached in this present monograph. However, the use of arbitration is possible in the individual scope of the Labor Law, but it is necessary to take some measures to protect the worker in order to guarantee the balance in the conflict settlement
