The target of the present work is to introduce to the topic of dignity of the death as one of the right of persons which guarantee the human being to die with dignity. The importance to approach the proposed subject is the consequence that there is no accepted agreement that define what is a degnified dead, as well for concept, existing, as for legislative lacunas on the subject. This will be source for risks to injure the principal right of human being, which is life. The development of the subject is based on analyses of existing situations; understandings medical, juridical and philosophic comparing the patriotic right as a jurisprudential support. In reality, the right of degnified dead, part of the right of personality resulting of own life, must be waranted for all human beings in respect of the principle of human dignity; each time, in application in concrete cases it don t intefere with the absolute right of life as observed in the present work
