Resumo: This study aims to assess the phenomenon of Disregard of the Legal Entity in the Brazilian legal system, with emphasis on bankruptcy law. Currently, the face of constant economic and financial conjecture in Brazil, faced with numerous companies that had decreed the bankruptcy of state. Thus, with the cool, doctrinal and jurisprudential analysis, we examine the verification of the member's responsibility to social obligations, as well as the assumptions allowed for the application of overcoming the legal personality in the other segments of law
