Licenciamento ambiental da atividade de silvicultura: uma análise sobre os conflitos de competência legislativa

This paper aims to study and analyze the concurrent legislative competence regarding environmental aspects, concepts of general rules issued by Federal Union, and the supplementary competence of the States, Federal District and Municipalities. We aim to apply the referred concepts in our analysis of rules (federal and state) regarding environmental licensing, especially with regard to forestry activities. In order to choose the states that will by analyze in this paper, we will use as a base the “Annual Report 2016”, issued by “Ibá – Indústria Brasileira de Árvores”, which ranked the mains Brazilian states regarding planted areas with exotic species. Therefore, we will verify the phatic situation, complexities, difficulties, legal (un) certainty, understandings expressed by Public Prosecutor (Federal and State), and respective lawsuits questioning the laws regarding the subject, conflicts of guidelines and legal systems between federal and states laws, importance of Judiciary and the main bill of law contained significant legislative changes regarding environmental licensing. After analyzing and comparing the referred elements, this paper aims to verify if rules regarding this subject are complying with limits brought by Federal Constitution of 1988
