The support law suit, established by Law 5.478/68, whose execution action is set by the 732, 733 and the following articles of the Code of Civil Procedure, for its nature and specificity, has its own sequence. By the rule of law 11.232/05, the ordinary proceeding phase has integrated with the enforcement phase in the same suit, for the syncretism of the executions of judgments, so that the condemnation sentences, besides their declaratory bias, were also endowed with executive effectiveness, no longer being necessary to file a new enforcement action. However, despite effective and faster, the sequence brought by the referred law has provoked discussion in the jurisprudence and precedents about the applicability of the Article 475-J of the Civil Procedure Code for maintenance obligations, settled by judgment and that have been defaulted. The demonstration of the applicability of the Article 475-J of the Code of Civil Procedure for the enforcement of maintenance decisions highlights the contrast between the specificity of the alimony action with its procedure for execution with the speed introduced by the Law 11.232 of 22/12/2005, controversy extremely important to the scope of Civil Procedure.
